Power of Attorney

General and Lasting Power of Attorney

General Power of Attorney

  • Lets one or more people make financial decisions on your behalf
  • Only valid while you still have mental capacity
  • Useful while you are in hospital, away or unable to get out
  • Signed in front of an independent witness, not an attorney

Lasting Power of Attorney

  • Continues to work if you lose mental capacity
  • Can cover property and financial affairs, or health and welfare
  • Must be registered with the Office of the Public Guardian before it can be used
Questions

Common questions

Cannot see your question? Ask us, there is no obligation.

If you die without a valid will, the intestacy rules decide who inherits your estate, which may not reflect your wishes. A will lets you decide who inherits and who looks after any children.

Review your will after major life events such as marriage, divorce, having children or buying a home. In England and Wales, getting married usually cancels an existing will.
